For the record:

There are now other Slicks in SL. When I started, I was the only one.

It's not a trademark infringement unless it's been registered, but it /is/ classless, tasteless, and stupid.

The term you are looking for is TRADEMARK and Life Savers is, indeed, a registered trademark

If you don't register your trademark with the patent office then you are pretty much SOL as I understand it and I am not a lawyer. So I'm going to go out on a limb and say that while this guy may be slimey -- hes prolly not breaking any laws.

Another example that comes immediately to mind is EarthTones and EarthSTones. Lucas Lameth owned Earthtones when .. I forget the owner's name but she came around and started Earthstones. A lot of people thought she did it purposefully, myself included. After she built her business though it was rather questionable however as her line really does revolve around stones and it was a natural name for the place. She fashions her line of jewelry around the use of recreations of semi-precious stones like agates, jaspers, etc. And Earthtones would not have shown up on a search of Earthstones. Lucas eventually changed his brand name.

In your case Coyo, I'm willing to bet that the owners of the new slicks simply didn't bother to do a search.

Not entirely true. You can automatically trademark anything by adding the letters (TM) to your mark ... and it's trademarked. It's not a registered trademark (so you can't use the ® symbol), but it's still a trademark and can be defended.

But if it goes to court, you're in a much stronger position if your trademark is registered since your date of first use, currency of use, public announcement and opportunity to contest has been vetted and approved. Without that process, you will have to dredge up proof that you used the mark first (and, of course, the other guy will challenge the authenticity of your proof) and it will be a big mess.

So the battle is a lot more difficult, but an unregistered trademark can still be defended.
